Terms of Service

These Terms of Service ("Terms") govern your use of the PauseTime app and related services (the "Service"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Not medical advice

PauseTime is a wellness and habit app. It is not a medical device and does not provide medical advice, diagnosis or treatment. Meditations, breathing exercises, sleep sounds and statistics are for general wellbeing only. Period, ovulation and fertile-window predictions are estimates and must not be used for contraception or to plan a pregnancy. Always consult a qualified health professional about medical questions, and stop any exercise that makes you feel unwell. In an emergency, contact your local emergency services.

2. Eligibility and accounts

You must be at least 13 years old (16 in the EEA and UK) to use the Service. Many features work without an account; signing in lets you back up and sync your records. You are responsible for keeping access to your email, phone number, Apple ID or Google account secure, and for activity under your account.

3. Premium subscriptions

• Premium unlocks additional content and features and is offered as auto-renewing monthly or yearly subscriptions, some of which include a free trial.
• Payment is charged to your Apple ID or Google Play account when you confirm the purchase, or when the free trial ends.
• Subscriptions renew automatically at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the current period ends.
• You can manage or cancel your subscription in your App Store or Google Play account settings. Deleting the app or your PauseTime account does not cancel a subscription.
• Any unused portion of a free trial is forfeited when you purchase a subscription.
• Refunds are handled by Apple or Google under their refund policies.
• Prices may change. We will give you notice as required by the app store and applicable law.

4. Acceptable use

You agree not to misuse the Service, including by accessing it without authorization, interfering with its operation, reverse engineering it except where the law allows, circumventing Premium restrictions, or using it to break any law or infringe the rights of others.

5. Content and intellectual property

The Service and its content, including audio, text, graphics and software, are owned by PauseTime or its licensors and are licensed to you for personal, non-commercial use. You keep ownership of the records you enter. If you send us feedback, you allow us to use it to improve the Service without any obligation to you.

6. Termination

You may stop using the Service and delete your account at any time in the app. We may suspend or end your access if you breach these Terms or if the law requires it. Terms that by their nature should survive termination will survive.

7. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free, or that predictions and statistics will be accurate.

8. Limitation of liability

To the fullest extent permitted by law, PauseTime is not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid for the Service in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, and consumers keep all mandatory rights under their local law.

9. App store terms

If you downloaded PauseTime from Apple's App Store, you acknowledge that these Terms are between you and PauseTime, not Apple; that Apple has no obligation to provide maintenance or support for the app; that Apple is not responsible for addressing any claims relating to the app; and that Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. If you downloaded PauseTime from Google Play, Google Play's terms also apply to your purchase.

10. Changes to these Terms

We may update these Terms. If a change is material, we will notify you in the app before it takes effect. Continuing to use the Service after the change takes effect means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the place where the operator of PauseTime is established, without regard to conflict-of-law rules, except where the mandatory law of your country of residence applies.
